These Terms of Use ("Terms") govern your use of HEXiT (the "App"), a mobile application published by Christopher Pallant, trading as IamPalski ("we", "us", "our"). By downloading, installing or using the App, you agree to these Terms. If you do not agree, please do not use the App.
01The App
HEXiT helps you build habits you want and break the ones you don't, track daily check-ins and streaks, and see insights about the personal traits — such as health or focus — your habits support. Insights are for motivation and self-reflection only and are not professional, medical or psychological advice.
02Licence
We grant you a limited, non-exclusive, non-transferable, revocable licence to use the App on any Apple-branded device that you own or control, in accordance with the Apple App Store Terms of Service and the Apple Standard End User Licence Agreement (EULA). You may not copy, modify, distribute, sell, reverse-engineer or attempt to extract the source code of the App, except where permitted by law.
03Purchases & subscriptions
The App may be free to download and may offer optional in-app purchases or auto-renewing subscriptions that unlock additional features.
- Prices are shown in the App and on the App Store at the point of purchase and may vary by region.
- Payment is charged to your Apple Account at confirmation of purchase.
- Subscriptions renew automatically unless auto-renew is turned off at least 24 hours before the end of the current period. Your Apple Account is charged for renewal within 24 hours before the period ends.
- You can manage or cancel a subscription in your Apple Account settings after purchase.
- Refunds are handled by Apple in accordance with their policies — we do not process payments or refunds directly.
04Your content
You retain ownership of the habits, check-ins and notes you create in the App ("Your Content"). You are responsible for keeping your own backups.
05Acceptable use
You agree not to:
- use the service for any unlawful purpose or in breach of these Terms;
- interfere with, disrupt or attempt to gain unauthorised access to the service or its systems; or
- use the service in any way that could damage, disable or impair it.
06Availability
We aim to keep the App working and available, but we do not guarantee it will be uninterrupted or error-free. We may update, change or withdraw the App (or features within it) at any time.
07Disclaimer & limitation of liability
The App is provided "as is" and "as available" without warranties of any kind, whether express or implied, to the fullest extent permitted by law. We are not liable for any loss of data, loss of profits, or any indirect or consequential loss arising from your use of, or inability to use, the App.
Nothing in these Terms limits or excludes our liability for death or personal injury caused by negligence, for fraud, or for any liability that cannot be excluded under applicable law. If you are a consumer, these Terms do not affect your statutory rights.
08Changes to these Terms
We may update these Terms from time to time. The "Last updated" date above shows when they were last revised. Continued use of the App after changes take effect means you accept the updated Terms.
09Governing law
These Terms are governed by the laws of England and Wales, and the courts of England and Wales will have jurisdiction, without affecting any mandatory consumer-protection rights you may have in your country of residence.
