These Terms of Use ("Terms") govern your use of Orbit AI: Video Analyzer (the "App"), a mobile application published by Christopher Pallant, trading as IamPalski ("we", "us", "our"). By downloading, installing or using the App, you agree to these Terms. If you do not agree, please do not use the App.
1. The App
Orbit AI analyses short-form videos using artificial intelligence — scoring content, identifying potential weaknesses and suggesting improvements. The insights the App provides are informational suggestions only and are not guarantees of any particular result, performance or outcome.
2. Licence
We grant you a limited, non-exclusive, non-transferable, revocable licence to use the App on any Apple-branded device that you own or control, in accordance with the Apple App Store Terms of Service and the Apple Standard End User Licence Agreement (EULA). You may not copy, modify, distribute, sell, reverse-engineer or attempt to extract the source code of the App, except where permitted by law.
3. Subscriptions & payment
The App is free to download and offers optional auto-renewing subscriptions to unlock additional features. All purchases are processed by Apple through the App Store.
- Subscription options and prices are shown in the App at the point of purchase and may vary by region (for example, a monthly and a yearly plan).
- Payment is charged to your Apple Account at confirmation of purchase.
- Subscriptions renew automatically unless auto-renew is turned off at least 24 hours before the end of the current period. Your Apple Account is charged for renewal within 24 hours before the period ends.
- You can manage or cancel your subscription in your Apple Account settings after purchase.
- Refunds are handled by Apple in accordance with their policies — we do not process payments or refunds directly.
4. Your content
You retain ownership of the videos and other content you submit for analysis ("Your Content"). You are responsible for ensuring you have the rights to any content you upload, and that it does not infringe the rights of others or break any law. You must not submit content that is unlawful, harmful, or that you do not have permission to use.
5. Acceptable use
You agree not to:
- use the App for any unlawful purpose or in breach of these Terms;
- submit content that infringes intellectual property or privacy rights;
- interfere with, disrupt or attempt to gain unauthorised access to the App or its systems; or
- use the App in any way that could damage, disable or impair it.
6. AI-generated output
The App's scores and suggestions are produced by automated systems and may not always be accurate or complete. You should use your own judgement and are responsible for any decisions you make based on the App's output. We are not liable for outcomes resulting from reliance on the App's suggestions.
7. Availability
We aim to keep the App working and available, but we do not guarantee it will be uninterrupted or error-free. We may update, change or withdraw the App (or features within it) at any time.
8. Disclaimer & limitation of liability
The App is provided "as is" and "as available" without warranties of any kind, whether express or implied, to the fullest extent permitted by law. We are not liable for any loss of data, loss of profits, or any indirect or consequential loss arising from your use of, or inability to use, the App.
Nothing in these Terms limits or excludes our liability for death or personal injury caused by negligence, for fraud, or for any liability that cannot be excluded under applicable law. If you are a consumer, these Terms do not affect your statutory rights.
9. Privacy
Your use of the App is also governed by our Privacy Policy, which explains what data we handle and why.
10. Changes to these Terms
We may update these Terms from time to time. The "Last updated" date above shows when they were last revised. Continued use of the App after changes take effect means you accept the updated Terms.
11. Governing law
These Terms are governed by the laws of England and Wales, and the courts of England and Wales will have jurisdiction, without affecting any mandatory consumer-protection rights you may have in your country of residence.
