Terms of Use

These Terms of Use ("Terms") govern your use of MOTRYN (the "App"), published by Christopher Pallant, trading as IamPalski ("we", "us", "our"). By downloading, subscribing to or using the App, you agree to these Terms and the Apple terms referenced below.

1. Apple standard licence

MOTRYN is licensed through Apple’s App Store. Apple’s Standard End User Licence Agreement applies to the App and is incorporated into these Terms. The App is licensed, not sold. If these App-specific Terms conflict with Apple’s Standard EULA, Apple’s terms control to the extent of the conflict.

2. Eligibility

You must be legally able to enter into these Terms. If you use MOTRYN for a business or another organisation, you confirm that you have authority to accept these Terms on its behalf. The App is intended for lawful vehicle record-keeping.

3. What MOTRYN provides

MOTRYN helps you organise vehicle details, mileage, services, repairs, MOT information, maintenance, expenditure, notes, receipts and related records. Features, export formats and subscription offerings may change as the App develops.

4. Your licence and acceptable use

Subject to these Terms and Apple’s Usage Rules, we grant you a limited, personal, non-exclusive, non-transferable and revocable licence to use MOTRYN on Apple-branded devices that you own or control. You must not misuse the App, interfere with its operation, use it unlawfully, distribute it, sublicense it, or reverse engineer or attempt to extract its source code except where applicable law permits.

5. Your records and ownership

You retain ownership of the vehicle information, photographs, documents, receipts, notes and other content you add to MOTRYN ("Your Content"). You are responsible for having the right to use that content, for its accuracy, and for avoiding unlawful, infringing or harmful material. We do not claim ownership of Your Content.

6. Local-only storage

Your Content is stored locally on your device. MOTRYN has no IamPalski account, developer-hosted cloud sync or external vehicle-record database. We do not receive or retain a server copy and cannot remotely inspect, restore, edit or delete Your Content.

7. Backups, exports and device changes

You are responsible for protecting Your Content. Before changing, selling, resetting, repairing or disposing of a device, or deleting or reinstalling MOTRYN, you must use the App’s available export tools and save a complete backup somewhere you control. Confirm that the export opens and contains the records you need before erasing the original data.

Deleting the App or losing access to the device may permanently erase local records. A subscription or restored purchase restores access to eligible paid features; it does not restore your vehicle records. Because there is no MOTRYN database or cloud copy, we cannot recover data that was not exported successfully. Any third-party destination you choose for an exported file is your responsibility and may apply its own terms.

8. Subscriptions and billing

Paid MOTRYN features may be offered through an auto-renewable subscription purchased using Apple’s in-app purchase system. The price, billing period, trial terms, included features and any introductory offer shown on the App Store purchase screen at the time you subscribe form part of your purchase. Payment is charged by Apple to your Apple Account. We do not receive or store your full payment-card details.

Unless cancelled, an auto-renewable subscription renews in accordance with Apple’s terms. Apple manages billing, renewals, price-change consent, taxes and transaction records. Availability and pricing may vary by country or region.

9. Cancelling a subscription

You must cancel through Apple’s subscription controls. On iPhone or iPad, open Settings → your name → Subscriptions → MOTRYN → Cancel Subscription. You may also manage eligible subscriptions through the App Store or other methods Apple provides. Deleting MOTRYN, deleting its local data, stopping use of the App or contacting IamPalski does not cancel an Apple subscription.

Cancellation normally stops the next renewal and access continues until the end of the current paid period, subject to Apple’s terms. Cancel before the renewal or free-trial deadline shown by Apple. IamPalski cannot cancel a subscription on your behalf because it is attached to your Apple Account. Current instructions are available from Apple Support.

10. Restoring purchases

If you reinstall MOTRYN or move to another Apple device using the same Apple Account, use the App’s Restore Purchases option where provided to restore eligible subscription access. Restoring a purchase restores the Apple entitlement only. It does not transfer or recover locally stored vehicle records; those require your own prior export and backup.

11. Refunds

Apple handles App Store payment disputes and refund requests under Apple’s policies. IamPalski does not directly process App Store refunds or hold your payment details. Any statutory rights or remedies available to you remain unaffected.

12. Vehicle information disclaimer

MOTRYN is an organisational tool and is not an official vehicle, MOT, insurance, tax, warranty, recall, finance or legal record. Information may be incomplete, out of date or entered incorrectly. Check important dates, roadworthiness and legal obligations against your original documents and the relevant official authority or qualified professional. Do not rely on the App as a substitute for required inspections, maintenance or professional advice.

13. Availability and changes

We aim to keep MOTRYN useful and reliable, but do not promise uninterrupted or error-free operation. We may fix, update, add, remove or withdraw features, and compatibility may depend on the supported iOS version and device. Where required, we will provide appropriate notice of material changes.

14. Intellectual property

MOTRYN, its software, design, branding and supplied content are owned by Christopher Pallant or the relevant licensors and are protected by intellectual-property laws. Your licence does not transfer ownership of the App or its intellectual property.

15. Privacy

The MOTRYN Privacy Policy explains the local-only storage model, exports, deletion, Apple’s separate processing and the optional website launch signup.

16. Termination

You may stop using and delete the App at any time, but you must separately cancel any active Apple subscription. Your right to use the App may end if you materially breach these Terms. Sections that by their nature should continue, including ownership, disclaimers and liability provisions, survive termination.

17. Warranty and liability

The warranties, remedies and liability terms applicable to your App Store licence are set out in Apple’s Standard EULA and applicable law. To the fullest extent permitted by law, we are not responsible for loss of locally stored records that were not exported or backed up, or for indirect or consequential loss arising from use of the App. Nothing in these Terms excludes liability that cannot legally be excluded, including liability for death or personal injury caused by negligence or for fraud, and nothing affects your mandatory consumer rights.

18. Third-party beneficiary

Apple and its subsidiaries are third-party beneficiaries of these Terms as they relate to the App Store licence and may enforce those terms against you as permitted by Apple’s requirements. Apple is not responsible for providing maintenance or support for MOTRYN.

19. Changes to these Terms

We may update these Terms when MOTRYN, its subscription offering or legal requirements change. The date above identifies the latest version. If a change materially affects your rights, notice will be provided through this page, the App or App Store information where appropriate.

20. Governing law

These Terms are governed by the laws of England and Wales, and the courts of England and Wales have jurisdiction, without affecting any mandatory consumer protections or rights you have under the laws of your country of residence.
