Terms of Use

These Terms of Use ("Terms") govern your use of Thorts: Second Brain Notes (the "App"), a mobile application published by Christopher Pallant, trading as IamPalski ("we", "us", "our"). By downloading, installing or using the App, you agree to these Terms. If you do not agree, please do not use the App.

1. The App

Thorts is a personal note-taking and productivity app that lets you capture notes, ideas, tasks and thoughts in a connected timeline. The App is provided for your personal, non-commercial use.

2. Licence

We grant you a limited, non-exclusive, non-transferable, revocable licence to use the App on any Apple-branded device that you own or control, in accordance with the Apple App Store Terms of Service and the Apple Standard End User Licence Agreement (EULA). You may not copy, modify, distribute, sell, reverse-engineer or attempt to extract the source code of the App, except where permitted by law.

3. Purchase & payment

The App is a paid download. All purchases are processed by Apple through the App Store and are subject to Apple's terms. Pricing is shown on the App Store at the point of purchase and may vary by region. Refunds are handled by Apple in accordance with their policies — we do not process payments or refunds directly.

4. Your content

You retain full ownership of the notes, text and other content you create in the App ("Your Content"). You are solely responsible for Your Content and for keeping your own backups. We do not claim any ownership of Your Content, and we do not sell it.

You agree not to use the App to store or share content that is unlawful, infringing, or that violates the rights of others.

5. Acceptable use

You agree not to:

• use the App for any unlawful purpose or in breach of these Terms;
• interfere with or disrupt the App or the servers or networks connected to it;
• attempt to gain unauthorised access to any part of the App or its systems; or
• use the App in a way that could damage, disable or impair it.

6. Availability

We aim to keep the App working and available, but we do not guarantee it will be uninterrupted or error-free. We may update, change or withdraw the App (or features within it) at any time.

7. Disclaimer & limitation of liability

The App is provided "as is" and "as available" without warranties of any kind, whether express or implied, to the fullest extent permitted by law. We are not liable for any loss of data, loss of profits, or any indirect or consequential loss arising from your use of, or inability to use, the App.

Nothing in these Terms limits or excludes our liability for death or personal injury caused by negligence, for fraud, or for any liability that cannot be excluded under applicable law. If you are a consumer, these Terms do not affect your statutory rights.

8. Privacy

Your use of the App is also governed by our Privacy Policy, which explains what limited data we handle and why.

9. Changes to these Terms

We may update these Terms from time to time. The "Last updated" date above shows when they were last revised. Continued use of the App after changes take effect means you accept the updated Terms.

10. Governing law

These Terms are governed by the laws of England and Wales, and the courts of England and Wales will have jurisdiction, without affecting any mandatory consumer-protection rights you may have in your country of residence.
